A Florida woman who sued an ice cream shop after claiming she swallowed metal shards, which ultimately led to permanent infertility, has been awarded a whopping $14 million by a jury. This verdict, delivered just last week, includes compensation for years of medical bills and acknowledges the severe harm she endured.
According to Unilad, Brandy Buckley’s nightmare began in September 2018 when she decided to treat herself to some butter pecan ice cream from Bruster’s Ice Cream in Palm Bay, Florida. She was at the drive-thru and took a big bite, expecting a sweet, creamy treat. However, as she started to scoop some out for her son, something felt incredibly wrong.
“I noticed there was a metal nail in the cone, almost embedded,” Buckley recounted. She initially thought the sensation in her throat was just a pecan since she was eating butter pecan ice cream. While many people already question the quality of ice cream these days, this situation proved to be far more extreme. The discomfort was persistent, prompting her to visit a hospital for an X-ray where the scan revealed the shocking truth: she had swallowed a sharp metal object. “It was a nail. I had swallowed a nail,” she confirmed.

While she might have only consumed a small amount of the contaminated ice cream, the damage was extensive. Doctors discovered two metal shards embedded in her intestines, which required her to undergo surgery. The most devastating complication, in my opinion, was a blood clot that formed, ultimately leaving Buckley unable to have more children. “That was my goal and my dream, to have more kids. It was crazy because who expects to get ice cream and find a nail in there?” she shared.
Buckley’s lawyers detailed in the lawsuit, filed in 2019 against Malabar Creameries, the franchisee, that eating the ice cream “ultimately resulted in permanent infertility,” preventing her “from having additional children.” Beyond the reproductive impact, the lawsuit also claimed Buckley suffered various injuries to her head, neck, limbs, and nervous system. She stated that she experienced a permanent loss of body functions and is still dealing with ongoing neurological damage.
The lawsuit accused Malabar Creameries of negligence, a claim the company denied in its 2020 response. Buckley sought damages exceeding $15 million to cover her extensive suffering and medical costs. The jury clearly sided with her, awarding her $14 million. John Alpizar, Buckley’s lawyer, praised the outcome. “We are grateful that this jury of six fulfilled their civic duty and listened carefully to all of the evidence,” Alpizar said of the verdict.
“This verdict reflects the seriousness of the harm our client endured and ensures accountability at all levels.”
