A couple passing through New York says a stranger spat toward them at Penn Station, but it was the police response that drew the biggest reaction online. The pair, who post as @firststatedates on TikTok, shared footage of the encounter, according to The Nerd Stash. They claim the man had been causing a scene inside one of the station’s shops before turning his attention to them.
According to the couple, the man had been yelling inside the shop and then walked “aggressively” toward them after stepping outside. They claim he passed directly in front of them and spat in their direction. The video shows the man, dressed in dark clothing and a hoodie, wandering through the station and appearing to shout at no one in particular.
As he passed the couple, he allegedly yelled a vulgar insult at them, and a confrontation followed. The footage shows the man traveling with the woman grabbing the stranger by his hoodie and shouting back. The stranger pulled free and kept repeating the insult while making a lewd gesture, then ran off before security officers could stop him.
The couple says officers told them they had to see it happen to step in
Police officers later arrived and spoke with the couple, who say they were told they could file a report. The pair said they were frustrated that the man had been allowed to leave without being questioned. When they asked why no one stopped him, one officer reportedly explained that he needed to witness a violation himself before taking action.
The couple also claims officers told them the man had been reported for harassing people before. They called it “shameful” that he faced no consequences, and in their caption they urged anyone traveling through the area to stay alert. They did not say whether they went on to file the report.
Penn Station is the busiest rail hub in the country, serving Amtrak, Long Island Rail Road and New Jersey Transit riders alongside several subway lines. Its corridors are patrolled by several departments, including the NYPD and Amtrak police. Responsibility can vary, however, depending on where in the complex an incident takes place, and the video does not say which agency responded.
Much of the reaction turned toward law enforcement rather than the stranger, as viewers questioned why the man was able to simply walk away. Some said they had run into similar behavior at the station and avoided the area as a result. Others steered the conversation toward politics, blaming state and city leadership for safety conditions in New York’s transit hubs.
The officer’s explanation does line up with how New York law generally works, however. Under state law, officers can typically make an arrest for a petty offense, such as a violation, only if it happens in their presence. Misdemeanors and felonies do not carry that same requirement, which means the outcome could have changed depending on how the encounter was classified.
Safety at Penn Station has drawn scrutiny before, including when a knife attack injured five commuters inside the terminal. The couple’s video adds a smaller but similarly unsettling moment to that conversation, and their frustration centers on what happened after the stranger was already gone.
The couple may still file the report officers offered, which could give investigators a formal record if the man is accused of harassing travelers again.
Attack of the Fanboy was unable to independently verify the responding officers’ side of the story, as this account originates solely from First State Dates’ TikTok video.
