Former NFL star Shawne Merriman is facing a federal lawsuit centered on allegations of a massive financial scheme. The investment firm ARI Agent LLC has initiated legal action against the retired linebacker, claiming he owes more than $2.5 million in unpaid financing.
This is not being presented as a simple contract disagreement, as ARI Agent LLC alleges that Merriman engaged in a deliberate, coordinated, multi-step scheme by Merriman to commit fraud, coercion, misrepresentation, and obstruction. According to the court documents, the firm contends these actions were specifically designed to avoid repayment and accountability.
According to TMZ, the funds in question were reportedly borrowed for Lights Out XF, a company founded by Merriman that focuses on mixed martial arts and entertainment. ARI Agent LLC claims that the business was essentially run into the ground, leading to a situation where there was no reliable revenue and an inability to meet basic obligations.
That ‘can of worms’ voicemail is basically a gift to the prosecutors
The firm characterizes these events as part of a pattern of misconduct designed to extract capital, conceal risk, and avoid repayment. Furthermore, the lender alleges that Merriman attempted to intimidate them to prevent recovery efforts. The company claims that the former athlete sent threatening messages, including voicemails suggesting that taking action against him would open a can of worms.
ARI Agent LLC is now seeking the full unpaid balance, along with additional damages, through the federal court system. In response to these allegations, Merriman has addressed the situation publicly. He stated, We filed a lawsuit against A.R.I. in Nevada some months ago and the matter is ongoing. I’m still hopeful there’s a resolution, but for now I’ll let the legal process take its course.
This current legal battle adds to a complex history of public and private disputes involving Merriman, who rose to prominence as a dominant force on the football field. While many athletes face legal scrutiny during their careers, some instances involve serious criminal allegations, such as the arrest of Alshon Jeffery for insurance fraud.
Merriman earned the nickname “Lights Out” during his time with the Maryland Terrapins. He was selected 12th overall by the San Diego Chargers in the NFL draft and quickly made an impact, earning NFL Defensive Rookie of the Year honors in his first season. Over his first three seasons, he recorded 39½ quarterback sacks and appeared in three Pro Bowls, alongside two All-Pro selections. His career trajectory changed as he was hampered by injuries during the following three seasons.
The Chargers waived him midseason, and he was subsequently picked up by the Buffalo Bills. His time with the Bills was also marked by injuries, and after being released and then re-signed, he retired at the end of the season. Throughout his career and retirement, Merriman has dealt with various legal and personal controversies. He was arrested and charged with battery and false imprisonment following an incident involving his then-girlfriend, reality TV star Tila Tequila.
She alleged that he choked and restrained her when she attempted to leave his home. However, those charges were dismissed less than a week later. Following that incident, Merriman filed a civil suit against Tequila, alleging intentional interference with contract, unfair competition, and trademark infringement. He claimed that Tequila had misused his Lights Out logo and disrupted business negotiations. While he initially secured a default judgment for $2 million, it was later set aside.
Both parties eventually moved to dismiss the claim, and the case was closed. Another significant legal matter involving Merriman arose recently. Following the death of Kimberly Fattorini, her parents, Deann and Ferdinand, filed a wrongful death lawsuit against Merriman, a nightclub, and other parties. Fattorini had died from an apparent overdose. In their suit, the parents alleged that their daughter had been drugged and possibly assaulted.
They referenced text messages sent by their daughter earlier that night, in which she claimed that Merriman had poured something into her drink. They expressed their belief that the substance was GHB. When paramedics arrived, they found Fattorini unresponsive, and the condition in which she was found led to further questions from her family, although a sexual assault exam was not performed by the coroner.
As the federal lawsuit from ARI Agent LLC proceeds, the focus remains on the financial allegations surrounding Lights Out XF.
