Vanessa Cruz recently challenged an automatic gratuity charge after a birthday dinner for her family of five at a New Jersey restaurant, BroBible reports. The bill for the meal exceeded $300, and she found an 18% tip added to the total despite the restaurant policy stating such charges apply only to parties of six or more.
“These restaurants and waitresses are getting out of hand with these tips,” Vanessa Cruz, who goes by the name @vannibk on TikTok, begins in a clip that has hundreds of thousands of views. The group included her husband, her mother-in-law, two children, and herself.
Cruz noted that the digital menu specifically mentioned the 18% automatic gratuity policy for larger groups. “Parties of six or more, we’re gonna add 18%. That’s fine. We had five,” Cruz shares. She felt the service provided was subpar, citing delays in receiving food and drinks. The situation escalated when the bill arrived with the extra charge already included. “They automatically add the tip 18%, and I was like nah,” she says.
The manager asked her to submit a formal review
Cruz decided to address the issue directly with the staff. When she questioned the waitress about the charge, the server reportedly attributed the automatic addition to the restaurant system. Cruz pointed out the specific fine print on the menu and requested to speak with a manager.
The manager confirmed that the system applies the gratuity automatically. Cruz told the manager that the cost and volume of their order did not justify a mandatory tip, especially given the quality of the service. She says the manager agreed with her perspective. “You’re right,” she recalls him saying.
The manager asked Cruz to submit a formal review regarding the incident. He suggested that documenting the feedback would help the owner consider changing the system. Cruz expressed frustration with the expectation of forced generosity, particularly when the service did not meet her standards.
“It’s not that we didn’t wanna pay, but it’s just, like, how dare you tell me how I have to be generous based on the level of service you gave me? It wasn’t even up there,” she explains. Moving forward, she plans to use cash for tipping to maintain control over the process. She noted that the entitlement regarding tips is something she cannot stand.
Viewers on the platform shared their support for her decision in the comment section. One viewer noted the importance of the principle involved. “It’s not about the tip, it’s about the principle. If you allow people to do whatever they want with your money without your consent, then it will become the norm. Heck no, fix my check and lemme decide,” one commenter wrote.
Another commenter agreed with the frustration regarding service quality. “I agree with you 100%; you cannot force me to give 20% when you only gave me 1% of service.”
Attack of the Fanboy was unable to independently verify the restaurant’s side of the story, as this account originates solely from Vanessa Cruz’s TikTok video.
