Man who secretly recorded his wife with robot vacuum after suspecting she’s cheating ends up in jail

A man in Taoyuan, Taiwan, recently learned the hard way that using your household gadgets to spy on a spouse can lead to serious legal trouble. While he successfully caught his wife in an affair, the method he chose to document the betrayal resulted in him being sentenced to five months in prison.

As reported by the Lad Bible, the couple, who married in 2021, usually resided with the husband’s parents. They reportedly maintained a vacation home in Guishan, Taoyuan, which they would visit on the weekends. By September 2023, the husband began noticing suspicious behavior that made him question his wife’s fidelity. 

His suspicions were fueled by the discovery of items in the vacation home that did not belong to the couple, such as a toothbrush used by an unknown man. After checking parking lot surveillance footage, he saw that a stranger had driven his wife to the house and stayed the night.

He used the robot vacuum to record her spouse 

The situation came to a head in December 2023. The husband reportedly decided to remotely activate the robot vacuum cleaner through an app, claiming he originally intended to use the device’s remote function to communicate with his wife. Instead, he discovered a stranger in the house. 

He then made the choice to activate the recording function on the vacuum. This footage reportedly captured the wife and the man interacting intimately, changing clothes, and even walking around naked. The husband used this evidence to file a civil lawsuit against his wife and the other man for the infringement of his spousal rights.  

He reportedly sought NT$2 million in damages, and the court eventually ordered the pair to pay him NT$500,000 after determining that their relationship had crossed the line of ordinary friendship. However, winning that civil case did not give the husband a pass on his own actions. 

The wife filed a countersuit against him for the unlawful recording of her private life. While the husband claimed that he was simply protecting his rights and gathering evidence of infidelity, the Taoyuan District Court rejected this defense. The judge noted that “without cause” means lacking a legally valid reason for such an invasion. 

The court emphasized that even in a marriage, individuals maintain a reasonable expectation of privacy. Spouses do not forfeit their right to privacy, and they cannot be subjected to arbitrary monitoring simply because a partner suspects an affair.

The court specifically highlighted that the recording of the wife while she was naked constituted a significant violation of her sexual privacy. The judge pointed out that this behavior exceeded what society could reasonably tolerate. 

Although the husband argued that the device might have produced lights or voice prompts during operation, the court found these indicators insufficient to prove that the wife was aware she was being filmed or that she had consented to it. The sentence handed down was reportedly five months in prison for the crime of unlawfully recording another person’s sexual acts. 

However, the judge provided the option for the sentence to be commuted to a fine of NT$1,000 per day, which totals NT$150,000. Because the husband was awarded a higher amount in damages from his civil suit, he is financially capable of paying the fine to avoid jail time.
